Legal Theories

BREACH OF CONTRACT

Defendants entered into contracts with consumers, accepted payment, and failed to perform their obligations under those contracts by not delivering the purchased goods.

FRAUD / FRAUDULENT MISREPRESENTATION

Defendants made material misrepresentations regarding their intent and ability to fulfill orders, knowing such representations were false, with intent that consumers rely on them, causing damages.

CONSUMER FRAUD ACT VIOLATIONS

Defendants engaged in deceptive and unfair trade practices in violation of state consumer protection statutes, including but not limited to:
